The Government suggests changes in the order of personal data protection

The Cabinet
of Ministers proposes to eliminate the gaps of the current Law "On
personal data protection" and improve the system of protection of personal
data, bringing it closer to European standards. Deputy Justice Minister Inna Yemelianova said this during a briefing at the Government
House on Thursday, May 17.
The draft
appropriate amendments have been developed by the Ministry of Justice including
a year of application of the law that entered into force January 1, 2011. To
work on the bill have been also invited experts of the European Commission,
Council of Europe and Eurojust, as the implementation
of appropriate legislation on personal data protection is an essential
component of process of Ukraine-EU visa regime liberalizing, as well as a part
in order to conclude Ukraine a cooperation agreement with Eurojust
and strategic cooperation with Europol.
The main
changes contained in the bill, proposed by the Cabinet of Ministers are
empowerment of the subject of personal data, specification of mechanisms for
the protection of personal data, improving the regulation of relations between
subjects of personal data and expand the grounds of processing personal data
without the consent of the subject of personal data.
A separate
part of the Law is a legal relations settlement in the area of cross-border
transfer of personal data.
Thus, it is
proposed to amend the current law regarding the need to identify by the Cabinet
of Ministers of Ukraine the list of countries that offer adequate protection of
personal data.
